TERMS OF SERVICE

LAST UPDATED: JANUARY 2025

Welcome to Hyenai. These Terms of Service regulate your access to and use of our software platforms, testing tools, and developer workspace products.

1. ACCEPTANCE

By accessing our digital infrastructure, you agree to be bound by these terms. If you do not agree to these terms, you must terminate your access immediately.

2. LICENSE TO USE

Hyenai grants you a limited, non-exclusive, non-transferrable license to use our web interface and subscription services. For local desktop software (SOVEREIGN), specific EULA terms apply.

3. PROHIBITED CONDUCT

You may not:

4. INTELLECTUAL PROPERTY

All code architectures, designs, module systems, and logos are the property of Hyenai. Any unauthorized reproduction is a violation of international copyright law.

5. SUBSCRIPTIONS & CANCELLATION

Subscriptions are billed in advance on a monthly or annual basis. You may cancel at any time through your dashboard. Access remains active until the end of the current billing cycle.

6. LIMITATION OF LIABILITY & USER RESPONSIBILITY

Hyenai provides all software and services entirely "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied. You explicitly agree that your use of our software—including Beta versions like SOVEREIGN—is at your own sole risk.

Third-Party API Keys (BYOK): Our desktop applications require you to provide your own AI API keys (e.g., DeepSeek, Gemini). You are entirely responsible for the security, billing, and strict compliance with the terms of those third-party providers. Hyenai assumes zero liability for unauthorized access, usage costs, legal entanglements, or damages resulting from the mishandling, exploitation, or specific outputs generated by your API keys.

Complete Subordination of Liability: In no event shall Hyenai, its founders, or affiliates be held liable for any direct, indirect, incidental, punitive, or consequential damages (including data loss, system failure, or financial loss) arising from your deployment of our software. You hold full responsibility for any and all consequences of your use or misuse of the software.

7. GOVERNING LAW

These terms are governed by standard international software laws and applicable regulations. Any disputes shall be resolved through binding arbitration.
